The USA is exemplary when it comes to the security of financial investments and property ownership.
Any natural or legal person with full legal capacity, other than citizens, residents and/or corporations having their registered office or branches in the following countries: UNITED STATES OF AMERICA, CANADA, AUSTRALIA, JAPAN or other countries where the offering of such an investment would be against local law would be or subject to an embargo by the United States.
Also excluded are persons and companies that are currently subject to insolvency and/or bankruptcy proceedings, as well as companies that are in liquidation.

With sufficient investment capital, a single investment is more flexible and often more profitable.
However, access to US Tax Liens is reserved exclusively for US individuals and companies. By participating in a pool in the form of a US corporation, foreigners can also participate in this form of investment. Pools also offer the opportunity to participate with lower sums.
Tax liens generate between 0.25% and 18% interest (before taxes) p.a. The exact interest rate is determined by a bidding process. Different investors underbid each other, whoever offers the county the lowest interest rate wins the contract.
Interest for borrowers who own a higher quality home is often lower than, for example, interest on unpaid taxes on vacant properties.
Investments are made through participation in a US corporation. The capital to be invested will be brought into the investment pool in the form of preferred shares without voting rights.
Upon completion of the investment, the Company repurchases the previously issued shares at the original issue price. The interest is distributed in the form of dividends. Alternative payment methods are possible by arrangement.
Tax liens can run for a few days up to seven years. For each individual tax lien, this depends on the debtor, who can pay off his land charges at any time during these seven years. If a debtor repays his open land charges plus interest, the money is usually available to the investing company within 2-4 weeks and can either be paid out to the investor or – if other lien auctions are running at the same time – be reinvested.
The minimum investment is USD 25,000 (twenty-five thousand US dollars). Higher investments are possible in steps of full thousands (26,000, 27,000,…).
At least ten (10) investors of USD 25,000 each are required to start a pool.
If fewer than ten investors come together, the investors get back their uninvested capital minus any bank fees.
As an individual investor, the minimum investment (when using our service) is USD 250,000. On the part of the states, however, there is usually no minimum investment for direct investments.
Different minimum:
In countries that have a regulation that this form of investment may only be offered to qualified investors without the publication of a prospectus, the minimum investment is the sum provided for in the local definition of a qualified investor. In these countries, the minimum denomination is always an integer multiple of the legally regulated minimum investment.
If a local legal regulation stipulates that only a certain number of investors may be admitted to this investment before a prospectus is required, the number of investors from this country is limited to the corresponding value.
After a certain waiting period (depending on the county 2-3 years) there is the possibility to initiate the foreclosure of the property. This can result in separate costs that have to be borne by the investor. If no foreclosure sale is initiated within 7 years, the tax lien expires and the invested capital is lost. All tax liens on this property will be paid from the proceeds of the foreclosure sale.
The investment is not secured. Total loss is possible.
As an individual investor: There is no liquid market for tax liens. In general, however, the shares in the Investment-Pool Corporation can be transferred to third parties. An administration fee may apply for the transfer.
In the pool: no, that is not possible. The offer to repurchase the Shares is subject to the repayment of the relevant Tax Liens.
The subscribed capital must be available to the company by April 30, 2024. If capital arrives late, there can be no guarantee that it can be fully placed on the market.

Due to the large amount of data, it is usually not possible to invest in very specific objects, but the desired county and the desired property class (home, apartment building, commercial property, …) can be selected.
An interest rate bid can also be set. In this case, the desired interest rate is always specified as the minimum bid. Minimum bids that are too high can mean that not all of the capital can be successfully invested in tax liens.
US capital gains tax is due on the interest income on a US corporation basis. At the time of publication of this document, this is 21%. The tax rate in the year in which the profits are realized is relevant for taxation.
For the management of the investments and the operation of the investment pool, a flat fee of 10% of the earned interest is charged.
Any fees incurred for deposits and withdrawals of capital shall also be borne by the investor and costs for the initiation and implementation of foreclosure auctions will be charged to the investor at cost price plus a service fee of 5% of the auction value.
US withholding taxes may apply based on the investor’s residency. The exact amount can be found in the respective double taxation agreement.
